Sounds like it might be the switch or the wiring. Look at the contact switch coming off the brake pedal. Sometimes, the little metal slider (where the small spring connects the pedal to the switch) will get hung up and not want to slide in the housing. Use just a dab of dielectric grease to lube the slider. I'm not a big fan of this setup.
If it's not that, make sure your wiring is good coming from the switch, and also where it connects to the lights. Can also be a bit of corrosion in the light sockets.
If that still doesn't fix it, post again; we'll find it.
