I think you could be right as when i pin the throttle in natural or 1st gear it doesn't reach the limiter and just stays at high revs. Excuse me if i might be explaining this oddly, as i am new to motor bikes and don't have a mechanical mind as of yet.

OK, the newer KLX's with FI have a rpm limiter in the top gear, that is a fact, for some countries. You have a newer KLX with a carb, but it may still have that limiter. Just do a search on the forum for "rpm limiter" or some variations, you'll find it. There is a mod to eliminate it. Just do the mod and try it. I don't know but I think it is in the ignition electronics and it ties into the tack or speedometer wiring or something like that. You may have to buy a new box or something. I had a buddy that had a ktm 350, he wouldn't even try and keep up with me on the hywy, but I'm running a 350/flat slide carb and balance my tires.

I would research that on here and do that mod.
I dropped 1 on the countershaft and never have hit a rev limit or max rpm. It is a limiter of some type. I have an 07 so I can't help you other than tell you that is what it is.
Did find one post about a clutch switch but it didn't state how it was done. But this was on a EFI version. While saying this i was using my phone to search for it. Will have to try doing more searching when back home from work.

No i was going to check with them about it not going past 95km/h. I don't expect them to do any mods.

What the hell ? That IS a carb !

Well ok.. If you do-up the proper mod combo and CVK setup, you get top speeds of over 100mph - even upside down !

P.S. I think that's like 853.2906 kph..
